The Department of Justice (DOJ) has exposed President Biden’s mishandling of classified documents, including those related to Afghanistan, since his time as vice president and senator.

Special counsel Robert Hur’s yearlong investigation revealed that Biden willfully retained and disclosed classified materials after his vice presidency, but the DOJ deemed his actions non-criminal.

The report, made public after White House attorneys requested no redactions, offers a jarring glimpse into Biden’s mental state. Hur did not recommend charges against Biden, citing the president’s “significantly limited” memory.

Biden’s retention of the documents surfaced in a media report, and he responded through his counsel that his team discovered the documents in early November 2022. This revelation raised concerns about Biden’s transparency, as he kept the findings from the public for over two months.

Republicans questioned whether the DOJ would investigate Biden’s handling of classified documents as intensely as it did former President Trump’s. Knowingly removing classified material from a secure location or willfully holding on to classified material is a federal crime.

While the DOJ concluded that Biden’s mishandling of classified documents did not amount to criminal behavior, Biden aides worry about the political fallout. As Biden runs for reelection, his campaign fears the special counsel report’s long-awaited details, which Trump is expected to highlight as an example of an unfair justice system. Trump faces felony charges in Florida for alleged willful retention of national defense information and obstruction of justice, with his trial set to begin later this year.
