A jailed pregnant woman in Florida is arguing that she should be released because her unborn child is being illegally detained.

Natalia Harrell, 24, has been behind bars since July, when she was charged with second-degree murder for allegedly fatally shooting another woman.

Her attorney filed a writ of habeas corpus in a Florida appeals court, arguing that her fetus is being illegally detained.

Attorney William M. Norris argues that the “unborn child” has not committed any crimes, is innocent, and should be discharged from jail.

“An unborn child has rights independent of its mother, even though it’s still in the womb,” the attorney told The Washington Post. “The unborn child has been deprived of due process of law in this incarceration. You simply have to have the unborn child as a factor in the equation.”
